Terms & Conditions
GENERAL TERMS:
The Company reserves the right to increase the membership fee at the time of renewal of membership of a Member.
Membership is personal and non-refundable ni any scenario. The Franchisee may assign its rights to any person, firm, or any other company without any prior notice to Members.
The Member agrees to pay the membership fees on time. The Member agrees to pay al costs incurred by the Company towards realisation of the due membership fee.
The Member shall never permit any person, other than himself or herself, to enter Vault Fitness Centre. If any person, other than the Member, is found using the same to access of the Vault Fitness Centre, then the membership of the Member who has allowed access to such person shall stand immediately terminated without any notice, and the Member shall not be entitled to any refund of membership fee. The trespasser shall be asked to leave the Vault Fitness Centre premises and upon payment of a fee equal to twice (2) the one (1) day guest pass fee for each day of default. fI the trespasser does not pay such fees, the Member, who allowed access to such trespasser, shall be liable to pay for the same.
MEMBERSHIP TYPE:
Several types of membership are offered at Vault Fitness Centre. The privileges applicable to the membership type chosen may vary. The facilities and services provided at each Vault Fitness Centre may vary. Each membership type includes the following core services:
a) access during regular hours of operations, and to location specified for such membership type;
b) use if al available machinery / equipments (cardio, strength, free-weight, BCA);
c) group studio classes as determined by us from time to time.
GYM ETIQUETTES:
The Member shall ensure that: (i) towels &deodorant are used at al times, for hygiene reasons; (i) only sports shoes must be worn for workouts; (i) getting non-members along si not permitted; (iv) he/she does not block equipment / machinery; (v) Pree-weights are racked ni the right place after use; (v) weights are not dropped / thrown on the floor; (vi) discipline shall be maintained at all times; (vii) he/she sign the membership registered; (viii) he/she at all times abide by rules of conduct, behaviour, dress code, equipment usafe, and use of services that are displayed within the Vault Fitness Centre: (viii) he/she
does not alow open the door for anyone; and (vi) photography and/or videography by the Member does not violate privacy of any other Member. Use of the recovery room is determined as per the needs by the fitness manager.
ADDITIONAL SERVICES:
Personal training and other special services are offered at selected Vault Fitness Centre. These services wil be provided for an additional charge or Pees. Such services are governed by Vault Regulations. Personal training services shall be provided by employees of the Franchisee or by independent contractors retained by the Franchisee. Regardless, al payments for such services shall be made to the Franchisee.
GUEST:
Al non-members wil be charged a guest fee. Any guest using the Vault Fitness Centre without paying guest fee shall be charged a fee equivalent to twice (2) the one (1) day guest pass fee for each day of default. Al guest / non-members shall abide by the terms and conditions of this MAF and Vault Regulations.
FREEZE AND RECIPROCITY:
Subject to the sole discretion of the Company, a Member may be permitted to freeze his/her membership. The Company may, on application from the Member ni person at the Home Vault Centre, freeze the membership term for a maximum period 1(one) month. tI is pertinent to mention that this option is only available for Members availing annual memberships and/or semi-annual membership. The payments due and payable during the freeze period shall be payable immediately after expiry of the freeze period.
A Member, availing semi-annual and annual memberships, has the option within his/her membership to use any Vault Fitness Centre, other than Home Vault Centre, for a maximum period of seven (07) days in a month without payment of any additional charges.
TRANSFER:
The Member has the right to transfer his/her membership from Home Vault Centre to any other Vault Fitness Centre by making a payment of Rs 2,500/- along with applicable taxes. Transfer of such a membership can only be made within the same membership type.
CANCELLATION OF MEMBERSHIP:
The Company retains the right to cancel or suspend the membership of any Member who violates the Vault Regulations. In case a Member is responsible for damaging any property / equipment of Vault Fitness Centre, the Member shall be responsible for the repair or replacement, or payment of damages as estimated by the Company.
SECURITY:
Vault Fitness Centre is equipped with 24 hour video surveillance technology which is constantly recording for the security of Vault Fitness Centre and that
the video surveillance can be remotely viewed at any time by the Franchisee. The surveillance technology does not protect the Member from any harm or
loss. Members must use caution at the time of entering and exiting the Vault Fitness Centre. Vault Fitness Centre may be equipped with a panic button or emergency button, to notify the Franchisee in case the Member requires medical help or feels threatened.
ASSUMPTION OF RISK:
Iunderstand and acknowledge that Service Provider and Franchisor are not associated or related to operations and management of the Vault Fitness Centre, in any manner whatsoever, and any dispute or claim shall not be made against the Service Provider and/or the Franchisor. Iexpressly waive my right to take any action or make any claim against the Service Provider and/or the Franchisor for any reason whatsoever. Ihereby release, indemnify, and hold harmless the Service Provider and the Franchisor with respect to any and al injury, disability, death, loss or damage to me and/or any other person and/or property that may arise out of or in connection with my use of any of the equipment or facilities or any other incident that occurs at the Vault Fitness Centre or in connection with my membership.
I undertake to never make any defamatory statements against the Service Provider and/or the Franchisor. Ishall be held liable for any defamatory statement and the Franchisee shall have the right to terminate my membership due to this breach without any liability whatsoever. Ialso acknowledge that Franchisor shall have the right to take appropriate legal action against me for breach of this Clause. Iundertake that Ishall be liable to pay damages for defamatory statements made against Service Provider and/or the Franchisor.
understand the risk of al injuries from activities and/or using any equipment at the Vault Fitness Centre. Iunderstand that such risk is significant and can result in permanent or partial paralysis and death. Iknowingly and freely assume al such risks, both known and unknown. I acknowledge that this is an unsupervised fitness centre / health club and Iassume all risks associated with or without using exercise equipment and exercising alone without the aid and presence of staff of the Franchisee on the premises. Iacknowledge that the Home Vault Centre is operated and managed solely by the Franchisee. Ihereby release, indemnify, and hold harmless the Franchisee with respect to any and al injury, disability, death, loss or damage to me and/or any other person and/or property that may arise out of or in connection with my use of any of the equipment or facilities or activities or any other incident that occurs at the Vault Fitness Centre or in connection with my membership. Iexpressly agree that this release is intended to be as broad and inclusive as permitted by the laws applicable in India.
The Member acknowledges that the Company is not responsible for any theft or loss or damage to Member's personal belongings. GOVERNING LAW AND DISPUTE
RESOLUTION:
understand that the validity, construction and performance of this MAF and Vault Regulations shall be interpreted in accordance with the laws of India. Any disputes and differences arising in relation to, under or in connection with this MAF or Vault Regulations or Vault Fitness Centre shall be settled by Arbitration, in accordance with the provisions of the Arbitration &Conciliation Act, 1996 and terms and conditions stipulated in Vault Regulations.
